Good afternoon, all. Quite a bit has changed in the last 18 months regarding environmental regulations, due to a recent Supreme Court decision (Sacket decision) and a new administration at the helm. Both these factors set the stage for important ? but not quite specific just yet - potential impacts - on your future projects.
Since the U.S. Supreme Court decision in the Sacket case was published in August 2023, within three months, the Environmental Protection Agency (EPA) changed its rules regarding the “Waters of the United States.” (WOTUS for short).
To provide more guidance to the public, the EPA issued its March 12, 2025 Guidance memorandum, titled, “?The proper implementation of the “continuous surface connection under the definition of the States of the United States under the Clean Water Act.”
While a number of you know about this important decision, the EPA guidance Memo is relatively new ? just published last week. Thus, I am attaching that memo here for your information and review. Click the button below for a copy of that memo.
